Privacy Policy

Design Philosophy ("Design Philosophy") respects your privacy and is committed to complying with the National Privacy Principles set out in the Privacy Act (Cth) 1988 as amended.

 
Protecting the privacy and personal data of our customers and other visitors to our website is of utmost importance to us and is an important aspect of the way in which we operate our business both online and offline. 
 
This Privacy Policy outlines the manner in which we handle your personal information in respect of retail services provided to you by us. Your "personal information" is any information about you that is capable of identifying you. 
 
1. OUR COLLECTION AND HANDLING OF YOUR PERSONAL INFORMATION

We only collect your personal information directly from you that are voluntarily provided, and we endeavour to limit the personal information we collect to that which is necessary for our online retail services and activities to fulfill orders placed by you and to communicate with you in relation to your orders. 

When collecting your personal information, we take reasonable steps to make you aware of the purposes for which the information is being collected by us. We will generally only use or disclose your personal information for the purpose for which we collect it, and for related purposes that we consider, are within your reasonable expectations. Otherwise we will seek your consent prior to using or disclosing your personal information for another purpose, unless we are required or authorised by law to do so without seeking your permission. 

We will take reasonable steps to destroy your personal information when it is no longer needed by us.  
When we dispatch orders to customers we send an email notification to every customer of the despatch of our order to you together with tracking details to enable you to keep track of the delivery of your order. If you do not provide us with a valid email and physical postal address, an order will not be sent by us.  


In addition, customers may also qualify for other benefits such as “promotions” or “specials” that we offer from time to time. If your personal information provided to us is not correct, you may not be entitled to any of these benefits. 

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

2. OUR STORE
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

 

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.


PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

3. THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information, will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

4. SECURITY 

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Design Philosophy uses the eWAY Payment Gateway for its online credit card transactions. eWAY processes online credit card transactions for thousands of Australian merchants, providing a safe and secure means of collecting payments via the Internet.

 All online credit card transactions performed on this site using the eWAY gateway are secured payments.
- Payments are fully automated with an immediate response.
- Your complete credit card number cannot be viewed by Design Philsosophy or any outside party.
- All transactions are performed under 128 Bit SSL Certificate.
- All transaction data is encrypted for storage within eWAY’s bank-grade data centre, further protecting your credit card data.
- eWAY is an authorised third party processor for all the major Australian banks.
- eWAY at no time touches your funds; all monies are directly transferred from your credit card to the merchant account held by Design Philosophy.

5. AUTOMATIC SERVER LOGS & COOKIES

Our web site server automatically collects various items of information when you use our website, including: 
your IP ("Internet Protocol") address (which, in general terms, is a unique identifier assigned to your computer when it is connected to the Internet); the operating system and Internet browser software you are currently using; and  
the data that you download (such as web pages or other document files and software), and the time that you download it. Although, in some circumstances, it may be possible to identify you from this information, we do not attempt to do so, and we only use this information for analysing and improving the use of our website, system administration, and similar related purposes. This information is not disclosed to any other party. 

Our Google analytics account captures demographic information based on the information you provide through Google. Google can track your visits to our website (and other websites) but it only collects data such as your age, gender and geographic location. Personal information you provide through your Google account is not collected. You have the ability to opt-out of the Google analytical features we use, so that this information is not collected and tracked. In order for Design Philosophy to provide its online services to its customers it uses the platform/systems of third party operators. Design Philosophy will take all reasonable steps to protect your personal information provided to such parties for the operation of its website.

Here is a list of cookies that will be used by Shopify. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.

6. EMAIL & MESSAGE FORMS

We may collect personal information from you (such as your name, email address, and any other personal information you volunteer) if you send us email or if you submit information to us using a message or feedback form. 
We will use this personal information to contact you to respond to your message, and for other related purposes we consider would be within your reasonable expectations. We will not use or disclose any such information for any other purpose without your consent. 

 
7. PROTECTION & TRANSMISSION OF PERSONAL INFORMATION

If we receive your personal information, we will take reasonable steps to store it such that unauthorised access, modification, disclosure, misuse and loss are prevented (such as by the use of password protection).

We reserve the right to disclose your personally identifiable information as required by law and when
we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding,

If any of our online retail services (including any email messages we send to you) contain links to other online services that are not maintained by us ("Other Services"), or if Other Services link to our online services, we are not responsible for the content of those Other Services or the privacy practices of the organisations that operate them, and by providing such links we do not endorse or approve the Other Services. This Privacy Policy applies only in respect of our services. 
 
9. INFORMATION TRANSFERRED OVERSEAS

We will not transfer any of your personal information to other parties that are outside of Australia (unless we have obtained your consent for this to occur). 

10. LINKS

Links on the Design Philosophy site to external entities are not covered within this policy. The terms and
conditions set out in this privacy statement only cover the domain name of Design Philosophy.

11. COMPLAINTS

If you believe that a breach of your privacy has occurred, we encourage you to contact us to discuss your concerns. 
 
12. AMENDMENT

We reserve the right to amend this Privacy Policy at any time. Any changes in this Privacy Policy will be reflected in the version that appears on our web site (which will always be the current version of this Privacy Policy).
